TERMS OF SERVICE

1. Agreement

These Terms of Service govern all use of sealsandcrests.com and all design commissions, purchases, and services provided by Seals & Crests, a studio of 8x10designs (“the Studio”). By placing an order, paying a deposit, or using this website, you agree to these Terms, the Refund & Cancellation Policy, the Shipping & Delivery Policy, and the Privacy Policy in full.

2. Services

The studio provides custom ecclesiastical design services, including seals, crests, logos, ceremony collateral, brand systems, fabric patches, and print fulfillment. All work is custom-commissioned. Descriptions, timelines, and deliverables for each engagement are defined by the package purchased or the written proposal provided.

3. Client Responsibilities

The client agrees to:

  • Provide accurate names, titles, dates, scripture references, and all content required for the commission
  • Review and approve proofs carefully before production. Approval transfers responsibility for all content accuracy to the client.
  • Respond to Studio communications promptly. Unresponsiveness for more than 30 days is governed by the abandonment terms in the Refund & Cancellation Policy.
  • Confirm they hold the rights to any materials submitted for use in a design, including photographs, existing logos, denominational marks, and text

4. Client-Submitted Materials

By submitting materials, the client warrants they own or are authorized to use them. The client agrees to indemnify and hold the studio harmless from any claim arising from materials the client provided, including trademark or copyright claims involving denominational or jurisdictional marks the client requested.

5. Timelines

Delivery estimates are made in good faith and depend on timely client feedback, proof approvals, and third-party production schedules. The final content deadline for event work is 10 business days before the service date. The studio is not liable for delays caused by the client, carriers, or production partners.

6. Payment

Commissions require a deposit to begin, with the balance due before release of final files or shipment of physical goods, unless a written payment schedule states otherwise. Accepted payment methods are listed at checkout or on the invoice. Late balances are subject to the terms in the Refund & Cancellation Policy.

7. Refunds & Cancellations

All refunds, cancellations, revisions, defects, and abandonment matters are governed by the Refund & Cancellation Policy, which is incorporated into these Terms. In summary: deposits are refundable only within 24 hours of payment, custom work is non-refundable once concepts are presented, and made-to-order physical goods are non-refundable once in production.

8. Intellectual Property

Ownership and usage rights are governed by the Intellectual Property & Design Usage Policy below. In summary: the client receives full usage rights to the final delivered design upon payment in full, and the Studio retains the right to display the work in its portfolio.

9. Portfolio & Promotion

The Studio may photograph and display completed work, including seals, patches, and ceremony collateral, in its portfolio, on its website, and on its social media. Clients who require confidentiality before a public announcement (for example, a consecration not yet announced) may request an embargo in writing, and the studio will honor it until the event date.

10. Limitation of Liability

To the fullest extent permitted by law, the studio’s total liability for any claim arising from a commission is limited to the amount the client paid for that commission. The Studio is not liable for indirect, incidental, or consequential damages, including event delays, lost revenue, or reprinting costs arising from client-approved proofs.

11. No Legal Effect of Designs

Seals and crests created by the Studio are artistic works. The Studio does not confer titles, offices, notarial authority, or legal registration of any kind and makes no representation regarding the legal effect of any seal.

12. Disputes

The parties agree to attempt good-faith resolution of any dispute directly before pursuing other remedies. These Terms are governed by the laws of the Commonwealth of Pennsylvania, and any proceedings shall take place in Philadelphia County, Pennsylvania.

13. Changes to These Terms

The studio may update these Terms at any time. The version in effect on the date of the client’s deposit governs that commission.
